Are there any standard ToS? One of the biggest advantages of open source for me, is that I can see "GPL2" or "MIT" or whatever, and immediately know what I can do with the software. If there were similar standard ToS and Privacy Policy documents, I'd happily use them on my projects, and it'd be better for creators and consumers in a lot of cases.
